Fair Use

Fair Use is a doctrine that allows use of copyrighted material without permission if it meets certain criteria. While the idea of fair use seems simple, it can actually be very complicated.

4 factors must be weighed when determining if use is fair:

  • Purpose and character of use
  • Nature of the copyrighted work
  • Amount or substantiality of the portion used
  • Effect of the use on the market for or value of the work

Fair Use seems simple enough but it can be really complicated. 4 factors must be weighed when determining if use is fair: Purpose and character of the work; nautre of the copyrighted work; amount or substantiality of the portion used; effect of the use on the market for or value of the work.
